These Terms of Service ("Terms") govern your access to and use of the Monbits Pay platform, website, APIs, and services (collectively, the "Services") provided by Monease.io ("Company," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms.

1. Eligibility and Geographic Restrictions

1.1 General Eligibility

To use Monbits Pay, you must:

• Have the legal capacity to enter into a binding agreement
• Be a legally registered business entity or authorized representative of such an entity
• Not be prohibited from using our Services under applicable laws

1.2 Geographic Restrictions

Monbits Pay explicitly does NOT provide services to the following jurisdictions:

• United States of America - Including all states, territories, and possessions
• United Kingdom - Including England, Scotland, Wales, Northern Ireland, and Crown Dependencies

This restriction applies to:

• Businesses incorporated or registered in these jurisdictions
• Businesses with their primary place of operation in these jurisdictions
• Individuals who are residents or citizens of these jurisdictions
• Businesses owned or controlled by entities or individuals from these jurisdictions

We reserve the right to request documentation to verify your jurisdiction and may suspend or terminate accounts that we reasonably believe are associated with restricted jurisdictions.

1.3 Your Responsibility

You are solely responsible for ensuring that your use of Monbits Pay complies with all applicable laws and regulations in your jurisdiction. This includes, but is not limited to, regulations concerning cryptocurrency, payment processing, anti-money laundering (AML), and know-your-customer (KYC) requirements.

2. Description of Services

Monbits Pay is a cryptocurrency payment gateway that enables businesses to accept digital currency payments. Our Services include:

• Payment processing for cryptocurrency transactions
• Payment link generation and management
• Multi-blockchain support (Ethereum, TRON, BNB Chain, Polygon, and more)
• Stablecoin support (USDT, USDC)
• Real-time transaction tracking and reporting
• API access for integration with your platforms
• Dashboard for transaction management

3. Account Registration and Security

3.1 Account Creation

To use certain features of our Services, you must create an account. When registering, you agree to provide accurate, current, and complete information about yourself and your business.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

3.3 Verification

We may require you to provide additional information or documentation to verify your identity, business registration, and jurisdiction. Failure to provide requested verification may result in account limitations or termination.

4. Fees and Payment

4.1 Transaction Fees

Monbits Pay charges a transaction fee of 0.5% on all processed payments. This fee is automatically deducted from each transaction.

4.2 Subscription Fees

Depending on your plan:

• Pro Plan: 0.5% transaction fee only, no subscription fee (requires $300K+ monthly volume)
• Starter Plan: 0.5% transaction fee plus $700/month subscription fee

4.3 Network Fees

Blockchain network fees (gas fees) are separate from our fees and are paid directly to network validators. These fees vary based on network congestion and are not controlled by Monbits Pay.

4.4 No Hidden Fees

We do not charge any hidden fees. All applicable fees are disclosed in our pricing section and in these Terms.

5. Prohibited Activities

You agree not to use our Services for:

• Any illegal activities or transactions
• Money laundering or terrorist financing
• Fraud or deceptive practices
• Transactions involving illegal goods or services, including but not limited to illegal drugs, weapons, or stolen property
• Circumventing geographic restrictions or sanctions
• Any activity that violates the rights of third parties
• Attempting to reverse-engineer, hack, or compromise our systems
• Reselling or redistributing our Services without authorization

6. Transaction Characteristics

6.1 Irreversibility

Cryptocurrency transactions processed through Monbits Pay are irreversible once confirmed on the blockchain. There are no chargebacks, refunds initiated by us, or transaction reversals. Any refunds must be initiated voluntarily by the merchant.

6.2 Price Locking

The cryptocurrency price is locked at the moment an order is created. This protects both merchants and customers from price volatility during the payment process.

6.3 Settlement

Funds are settled directly to your designated wallet upon blockchain confirmation. Settlement times depend on the blockchain network used.

7. Intellectual Property

All content, trademarks, logos, and intellectual property associated with Monbits Pay are owned by Monease.io. You may not use, reproduce, or distribute any of our intellectual property without prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law, Monbits Pay and its affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Damages arising from blockchain network issues or delays
• Losses due to price volatility of cryptocurrencies
• Unauthorized access to your account due to your negligence

9. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Indemnification

You agree to indemnify and hold harmless Monbits Pay, Monease.io, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our Services or violation of these Terms.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting our support team.

11.2 Termination by Us

We may suspend or terminate your account immediately if:

• You are found to be operating from or associated with a restricted jurisdiction (United States or United Kingdom)
• You violate any provision of these Terms
• You engage in prohibited activities
• We are required to do so by law or regulatory requirement
• We reasonably believe your account poses a risk to us or other users

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on our website and updating the "Last updated" date. Continued use of our Services after changes constitutes acceptance of the modified Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of our Services shall be resolved through binding arbitration, except where prohibited by law.
